양도소득세 주택연면적이 주택 외의 연면적보다 큰 겸용주택이 고가주택에 해당하는 경우 양도차익 등의 계산

주택연면적이 주택 외의 연면적보다 큰 겸용주택의 주택으로 보는 부분의 양도가액이 12억원 이하인 경우 비과세한다. 고가주택의 실지거래가액을 계산하는 경우에는 주택의 연면적이 주택 외의 연면적보다 커서 주택으로 보는 부분(부수토지 포함)에 해당하는 실지거래가갱을 포함한다(소령 156조 2항). 이 경우 주택의 실지거래가액이 12억원 이하인 경우 주택은 전부 비과세되나, 12억원을 초과하는 경우 2022.1.1. 이후 양도분부터 양도차익과 장기보유특별공제 계산시 주택 외의 부분은 주택으로 보지 않는다(소령 160조 제1항). 따라서 주택 외의 부분의 양도차익은 비과세되지 않고 장기보유특별공제도 소득세법 제95조 제2항 [표1](최대 30%)을 적용하여야 한다. (종전 : 주택 외의 부분도 주택으로 보아 비과세혜택을 주고 장기보유특별공제도 [표2](최대80%)를 적용하였음)
주택부분 중 비과세대상에서 제외되는 양도차익과 장기보유특별공제액은 소령 160조 1항에 따라 다음과 같이 계산함.
1. 고가주택에 해당하는 자산에 적용할 양도차익
양도차익 × (양도가액 - 12억원) / 양도가액
2. 고가주택에 해당하는 자산에 적용할 장기보유특별공제
장기보유특별공제액 × (양도가액 - 12억원) / 양도가액
